A Roswell car accident usually happens on a road you drive every day: GA-400 at rush hour, Holcomb Bridge Road between shopping centers, Alpharetta Highway on the way home. Knowing the road doesn't make the aftermath any easier, especially once the other driver's insurer starts calling.
Gary Huggins of Huggins Accident Injury Lawyer works as a Roswell car accident lawyer from Perimeter Center, about 15 to 20 minutes down GA-400 outside rush hour. He can meet you at home in Roswell, at Wellstar North Fulton Hospital or by video. Call (240) 421-5511 to start.
Where Roswell car accidents happen
GA-400, now a construction corridor
GA-400 is Roswell's commuter spine, and a backup can stretch across several interchanges. When a driver looks down at a phone or follows too closely, one rear-end crash can turn into a chain reaction.
The highway is also being rebuilt. According to GDOT, construction is underway on the SR 400 Express Lanes, roughly 16 miles of optional toll lanes between the North Springs MARTA station and McFarland Parkway, and the new lanes are expected to open in 2031. Roswell's stretch of GA-400 falls inside that corridor. Work-zone crashes raise extra questions: whether lane closures and signs were set up properly, and whether a contractor or the state shares the blame.
Holcomb Bridge Road
For many Roswell drivers, Holcomb Bridge Road is the way on and off GA-400. Turn lanes, plaza driveways and drivers changing lanes for the ramps pack a lot of decisions into a short distance. East of GA-400, the road heads toward the Chattahoochee and Gwinnett County, where a crash may fall to a different police agency and county court.
SR-9 and Canton Street
SR-9 runs through the heart of the city. North of downtown it's Alpharetta Highway, lined with retail entrances; to the south it passes the historic district and crosses the Chattahoochee into Sandy Springs.
Canton Street's restaurants draw evening crowds, which brings parking-lot fender benders, people stepping out between parked cars and, late at night, the risk of an impaired driver. If a drunk driver hit you, the usual $250,000 cap on punitive damages doesn't apply (O.C.G.A. § 51-12-5.1). See our drunk driving accident page.
SR-92, Old Alabama Road and Mansell Road
SR-92 (Crossville Road) heads northwest out of the city, while Old Alabama Road and Mansell Road connect neighborhoods to GA-400 and Alpharetta. Drivers on these roads often come from neighboring counties, which can affect where a lawsuit is filed.
Give Gary the road, the direction you were heading and the nearest cross street. Call (240) 421-5511, and he'll explain which agency, which cameras and which court are likely involved.
What makes a Roswell car accident claim different
- The agency can change at the river. Inside city limits, the report comes from Roswell Police; a GA-400 wreck may instead be worked by the Georgia State Patrol. Cross the Chattahoochee on SR-9 and it's Sandy Springs Police (see our Sandy Springs car accident page); cross it on Holcomb Bridge Road and it's Gwinnett County Police. Whichever agency it was, its report will usually be available on BuyCrash.com within days, for a small charge.
- Care starts in Roswell. Wellstar North Fulton Hospital is a Level II trauma center. If doctors sent you on to Grady Memorial for a higher level of care (Grady is a Level I trauma center), request records from both hospitals.
- Venue follows the defendant. Sue a Fulton County driver and the case typically lands in the State Court of Fulton County downtown; a commuter from another county may have to be sued in that county's State Court.
- Work and rideshare policies. If the other driver was on the clock or driving for Uber or Lyft, a commercial or rideshare policy may sit on top of the driver's own coverage. A rideshare driver on an accepted trip must be covered by at least $1 million in liability insurance (O.C.G.A. § 33-1-24).
The Georgia rules that decide a Roswell car accident claim
Chain reactions and the 50% rule. GA-400 pileups can involve several cars, and Georgia juries can spread fault across every driver in the chain, including one who was never sued (O.C.G.A. § 51-12-33). A share of 50% or more bars your recovery; anything less reduces it by that percentage. The order of impacts matters, and photos of every car's damage help sort it out.
Minimum coverage gets split. Georgia's liability minimum is just $25,000 for each injured person, capped at $50,000 for the whole crash. In a multi-car crash, several injured people may be drawing on that same $50,000. That's where your own uninsured/underinsured motorist coverage matters. Added-on UM, the standard choice on Georgia policies since 2009 unless the policyholder picked reduced-by in writing, is paid in addition to the at-fault driver's coverage. Reduced-by UM subtracts that coverage first.
Phones behind the wheel. Holding or propping up a phone while driving has been illegal in Georgia since July 1, 2018, under the Hands-Free Georgia Act (O.C.G.A. § 40-6-241). In a GA-400 rear-end crash, phone records can show whether the other driver was distracted; read more about Hands-Free Georgia Act claims.
Deadlines. Most injury claims must be filed within two years (O.C.G.A. § 9-3-33). If the state is involved, as it may be in a GDOT work zone, written notice must go out within 12 months (O.C.G.A. § 50-21-26).
SB 68 and medical bills. For any crash from April 21, 2025, onward, the jury may learn what your health plan actually paid (O.C.G.A. § 51-12-1.1). Hang on to every bill and explanation of benefits.

Gary's first week on a Roswell crash
- A meeting where you are: our office, phone or video, your home or a room at Wellstar North Fulton.
- Every driver, every insurer. In a multi-car crash, he identifies each vehicle and its coverage so no one's share of the fault is overlooked.
- Phone and video evidence. He sends preservation requests for dash-cam and business video and, when distraction is suspected, for the other driver's phone records.
- Work-zone records. After a crash in a construction area, he asks the state and its contractors to keep the traffic-control plans and daily logs for that day.
- Your own UM claim. He notifies your insurer early so any uninsured motorist claim stays on track.
- Bills and liens. Health plans and hospitals may expect repayment from any recovery, so he tracks those claims from the start, including hospital liens (O.C.G.A. § 44-14-470).
Roswell clients hire Gary on contingency, which means no attorney's fee unless we recover compensation for you.

Questions people ask about roswell car accident
How long do I have to file a claim after a Roswell car accident?
Most injury lawsuits have a two-year deadline (O.C.G.A. § 9-3-33), and vehicle damage claims have four (O.C.G.A. § 9-3-31). Government claims run shorter: six months for written notice to the City of Roswell (O.C.G.A. § 36-33-5), and 12 months for Fulton County or the state, including a crash tied to a GDOT work zone. None of these deadlines pause while you negotiate with an insurer.
Who is at fault in a GA-400 chain-reaction crash?
Often more than one driver. The driver who started the chain usually carries the most blame, but each driver behind is expected to keep a safe distance, and a jury can spread fault across everyone, including drivers who were never sued (O.C.G.A. § 51-12-33). If you're found less than 50% responsible, you can recover, reduced by your share. Photos of every car, witness names and dash-cam video help show the order of impacts.
What if I was hurt in a GA-400 construction zone?
Drivers still have to slow down and follow posted work-zone signs, so the other driver may be responsible. But if a lane closure was poorly set up or signed, the state or a contractor may share fault. Before suing the State of Georgia, you must give written notice within 12 months; damages against the state are capped at $1 million per person (O.C.G.A. § 50-21-29), and immunity rules apply. Photograph the signs, cones and lane markings.
Can I sue a Canton Street restaurant that served the drunk driver who hit me?
Only in narrow circumstances. Under O.C.G.A. § 51-1-40(b), a seller is liable only for willfully, knowingly and unlawfully serving an underage person, or for serving someone noticeably intoxicated while knowing that person would soon drive. Receipts, video and witnesses can show what the staff saw. The impaired driver remains the main target, and punitive damages against an impaired driver aren't capped.
My crash was on Holcomb Bridge Road across the river in Gwinnett. Does that change anything?
The law is the same, but the details shift. Gwinnett County Police likely wrote the report, and if the at-fault driver lives in Gwinnett, a lawsuit may belong in Gwinnett's State Court in Lawrenceville rather than in Fulton. Hospitals, witnesses and cameras may differ too. Gary handles claims in both counties and can meet you in Roswell either way.
