Traffic in Duluth comes in waves: commuters on I-85 every weekday, shoppers along Pleasant Hill Road all weekend, and crowds heading to the Gas South District on event nights. Each wave brings its own kind of wreck.
As a Duluth car accident lawyer, Gary Huggins of Huggins Accident Injury Lawyer handles claims from all three, working from his office in Perimeter Center. He speaks Spanish and will come to you. Call (240) 421-5511 to talk tonight.
Three kinds of Duluth car crashes, and what each means for your claim
Chain-reaction crashes on I-85
When I-85 traffic stops without warning, the car at the back of the line can shove several others together. Sorting out who hit whom, and in what order, decides who pays.
Each driver's insurer answers for that driver's share of the fault, and a Georgia jury can even assign fault to a driver who isn't in the lawsuit (O.C.G.A. § 51-12-33). Gary's job is to name every car in the chain, not just the one that hit you.
There's a money problem, too. A minimum Georgia policy pays $25,000 per injured person and no more than $50,000 for everyone hurt in a crash, so in a pileup that limit can be split several ways.
If a tractor-trailer started the chain, see our page on truck accident claims.
Turning crashes on Pleasant Hill Road and Satellite Boulevard
Both roads are lined with plazas, restaurants and big stores. Drivers turn left across several lanes and pull out of driveways into moving traffic, which sets up T-bone and angle crashes.
These cases often come down to who had the green light or the right of way, and drivers rarely agree. Store cameras, dash cams and witnesses who stayed at the scene usually settle it, and store video may be kept only briefly.
Event nights near the Gas South District
Shows and games at Gas South Arena bring crowds of drivers who don't know Satellite Boulevard, plus rideshare cars stopping to drop off and pick up. If an Uber or Lyft driver hit you, the app's status at that moment decides which coverage applies (O.C.G.A. § 33-1-24):
- App on, no ride accepted yet: minimums of $50,000 for each injured person and $100,000 per crash
- From accepting a ride to drop-off: a $1 million liability minimum
- App off: the driver's personal policy only
Our page on Uber and Lyft accident claims covers the details. And if the other driver was impaired, Georgia's usual $250,000 cap on punitive damages doesn't apply (O.C.G.A. § 51-12-5.1).
Tell Gary which of these sounds like your crash. Call (240) 421-5511, and he'll explain which insurance should pay first.
Other Duluth roads where cars collide
Peachtree Industrial Boulevard carries faster traffic past Duluth, so a red-light or rear-end crash at one of its big intersections can be severe. Buford Highway (US-23) passes by downtown Duluth, where frequent signals and people on foot slow things down but turning traffic keeps coming.
Duluth Highway (GA-120) carries commuters east toward Lawrenceville. If your crash happened farther out that way, our Lawrenceville car accident lawyer page covers that end of the county.
Georgia rules that decide a Duluth car crash claim
The filing deadline. In Georgia, you usually have two years after the crash to bring an injury lawsuit (O.C.G.A. § 9-3-33), and four years for the car, including repairs, a rental or a total loss (O.C.G.A. § 9-3-31).
Public vehicles shorten the clock. The City of Duluth must be notified in writing within six months, Gwinnett County within 12.
The 50% bar. A share of blame under 50% lowers your award by that percentage; a share of 50% or more wipes it out.
Phones. Georgia's hands-free law (O.C.G.A. § 40-6-241), on the books since July 1, 2018, forbids holding or supporting a phone while driving, along with texting and watching video. In stop-and-go traffic on Satellite Boulevard or I-85, a driver who glances down can rear-end you before looking up. Read more about distracted driving claims.
SB 68. Seat-belt use can now come up at trial in pending and future cases (O.C.G.A. § 40-8-76.1(d)). And when a crash happened on or after April 21, 2025, the defense may show jurors what your health insurer paid, not just what was billed (O.C.G.A. § 51-12-1.1).
Lawsuits over Duluth crashes are often filed in the State Court of Gwinnett County, at 75 Langley Drive in Lawrenceville. A driver who lives in another county can change that. For a deeper look at these rules, visit our Atlanta car accident lawyer page.
When the other driver's policy runs out
Because Georgia is an at-fault state, the claim starts with the liability policy of the driver who caused the crash. When that policy can't cover everything, the next place to look is your own policy's uninsured/underinsured motorist (UM) coverage.
Here's a hypothetical. The at-fault driver carries $50,000, and you carry $100,000 in UM:
- With added-on UM, up to $150,000 may be available.
- With reduced-by UM, the total tops out at $100,000, because the driver's $50,000 is subtracted.
Since January 1, 2009, added-on coverage has come standard on Georgia policies unless the insured turned it down in writing. Med-pay, if you bought it, pays medical bills no matter who caused the crash, and health insurance can cover treatment while the claim is open.
Wondering whether your policy is added-on? Call (240) 421-5511, and Gary will check the declarations page with you.
Gary's first week on a Duluth car crash claim
Day one is about you: where you're treating, what hurts and what the insurers have already asked. Gary tells every insurer to contact him instead. If the other driver's adjuster wants a recorded statement, you can say no.
Next comes the evidence: the crash report from Duluth Police, Gwinnett County Police or the State Patrol, photos, witness names, and letters asking stores along Pleasant Hill Road or Satellite Boulevard to keep their video.
Then the money: every policy that might pay, every bill from Northside Hospital Duluth, Northside Hospital Gwinnett (a Level II trauma center in Lawrenceville) or wherever you were treated, and any hospital lien (O.C.G.A. § 44-14-470). You'll know which deadlines apply and what comes next.

Questions people ask about duluth car accident
Who pays when several cars crash on I-85 near Duluth?
Every driver who helped cause the pileup can be responsible for a share, through his or her own liability insurer. A Georgia jury assigns fault by percentage, and any share it gives you reduces your award. If one at-fault driver carries only the minimum, that policy’s $50,000 per-crash limit has to cover everyone that driver hurt, so your own uninsured/underinsured motorist coverage may matter a great deal.
What if the driver who hit me in Duluth was texting?
Texting at the wheel violates the Hands-Free Georgia Act (O.C.G.A. § 40-6-241), and that’s strong evidence the driver was careless. If a lawsuit is filed, phone records can be requested to show whether the phone was in use at the moment of the crash. Witnesses who saw the driver looking down, and what the driver told police, help too. Any ticket is handled separately from your injury claim.
How long will my Duluth car accident case take?
No one can promise a timeline. A claim usually can’t be valued until you finish treatment, or until your doctor can say what future care you’ll need. Some claims settle through negotiation with the insurer. Others need a lawsuit, often in the State Court of Gwinnett County, which adds time for evidence-gathering and mediation. Gary will tell you what to expect at each stage and keep you posted.
Should I see a doctor if I feel fine after a fender-bender on Satellite Boulevard?
Yes, and soon. Neck and back injuries and concussions don’t always hurt right away, and adrenaline can hide pain for hours. A gap between the crash and your first visit is something insurers point to when they argue you weren’t really hurt. Under Georgia’s 2025 tort reform, careful medical records and bills matter even more, so start the paper trail early.
What if a Gwinnett County vehicle hit me?
You can still make a claim, but the county must receive written notice within 12 months of the crash (O.C.G.A. § 36-11-1). For a City of Duluth vehicle, the notice deadline is six months (O.C.G.A. § 36-33-5). Governments are protected by immunity except where Georgia law waives it, and for county vehicles that waiver is generally tied to the insurance the law requires. These rules are technical, so call early.
