Doraville is a small city with big traffic. Buford Highway runs through the middle of it, I-285 cuts across it, and Spaghetti Junction, where I-85 and I-285 meet, is just down the road.

As a Doraville personal injury lawyer working a few exits west in Perimeter Center, Gary Huggins helps people hurt on all of them. Huggins Accident Injury Lawyer handles car accident claims, truck crashes, pedestrian injuries and wrongful death cases, and Gary speaks Spanish.

Living next to Spaghetti Junction

Spaghetti Junction is the Tom Moreland Interchange, a stack of multi-level ramps where I-85 and I-285 cross just east of Doraville. Heavy freight traffic and drivers swerving at the last second for the right ramp make it a hard place to drive. Under Georgia Department of Public Safety rules, through trucks can't use I-75, I-85, I-20 or GA-400 inside I-285, so long-haul rigs stay on the Perimeter as it passes Doraville.

When a tractor-trailer is involved, the claim changes. An interstate for-hire carrier of general freight needs at least $750,000 in liability insurance under federal rules (49 C.F.R. § 387.9), and Georgia law lets injured people sue a motor carrier's insurer directly in some cases. Driver logs, maintenance records and the truck's onboard data can decide a case, and they need to be requested early: federal FMCSA rules require carriers to keep drivers' hours-of-service records (ELD data) for only six months.

Call (240) 421-5511 if a truck was involved; the sooner Gary asks for the trucking company's records, the more likely they still exist.

Buford Highway and the Doraville MARTA station

Buford Highway is Doraville's main street and the heart of its restaurant scene. It is also a road where people on foot face real risk: long blocks without crosswalks, many lanes of traffic and a history of pedestrian deaths along the corridor. The Doraville MARTA station, at the end of the Gold Line, brings riders onto nearby streets every day.

If you were hit while walking, the rules cut both ways. A pedestrian outside a crosswalk is supposed to yield (O.C.G.A. § 40-6-92), but that alone doesn't sink a claim. As long as a jury finds you less than 50% at fault, you can recover, minus your share.

MARTA is a different kind of defendant. A claim against the transit authority can come with special notice rules and a shorter deadline than the usual two years, so call right away.

Peachtree Industrial Boulevard, New Peachtree Road and Tilly Mill Road round out the map, linking Doraville's neighborhoods, Assembly Atlanta (the studio campus on the old GM plant site) and the MARTA station to I-285.

How Georgia's insurance rules play out after a Doraville crash

Georgia runs on fault. Whoever caused the wreck answers for it through their liability policy, and Georgia only requires drivers to buy so much: $25,000 for one injured person, $50,000 for everyone hurt in the crash combined, and $25,000 for property (the “25/50/25” minimum).

After a serious wreck, $25,000 doesn't go far. That's when your own uninsured/underinsured motorist (UM) coverage matters. Here's a hypothetical example:

  • The at-fault driver carries $25,000 in liability coverage.
  • You carry $100,000 in added-on UM. Up to $125,000 may be available: their $25,000 plus your $100,000.
  • If your $100,000 UM is reduced-by instead, up to $100,000 is available in total, because their $25,000 is subtracted.

Since January 1, 2009, Georgia policies are added-on by default unless you rejected that in writing. Gary checks which kind you have.

Two more rules apply to every claim. You generally have two years to file suit (O.C.G.A. § 9-3-33). And O.C.G.A. § 51-12-33 shuts the door on anyone a jury finds 50% or more at fault.

Who pays your medical bills while you wait?

Settlement money comes at the end, but the bills start right away. In the meantime:

  • Your health insurance can pay for treatment as you go.
  • Med-pay coverage on your auto policy, if you bought it, pays medical bills no matter who caused the crash.
  • Hospitals can file a lien against your settlement under O.C.G.A. § 44-14-470.
  • Some doctors treat patients under a letter of protection and wait to be paid from the settlement. For crashes on or after April 21, 2025, SB 68 lets the defense ask about those arrangements.

Gary keeps track of every bill so nothing is left out of your claim.

What Gary handles in the first week

Think of it as three jobs.

Protecting you. Gary tells the insurers to contact him, explains why you don't owe the other driver's insurer a recorded statement, and makes sure your medical care is documented.

Protecting the evidence. He requests the crash report, 911 audio and business camera footage along Buford Highway. After a truck crash, he sends the trucking company a letter asking it to preserve logs and vehicle data.

Protecting the claim. He reviews every policy that might pay, tracks bills and hospital liens, and calendars every deadline, including any notice to MARTA, the city or the county.

When a crash takes a life

Losing someone in a crash on I-285 or Buford Highway brings a different kind of claim. Georgia's wrongful death law asks what the life was worth to the person who lived it: their lost earnings and the simple value of being alive, with nothing subtracted for their personal living expenses (O.C.G.A. § 51-4-1 et seq.). The claim belongs first to a surviving husband or wife, who splits the recovery equally with any children but never gets less than a third. If there is no spouse, the right passes to the children, then to the parents.

The estate has its own claim for medical and funeral costs and for the pain your loved one consciously endured before death. The deadline is generally two years from the date of death. In some situations it can be paused, but don't count on that.

Questions people ask about doraville personal injury

What should I do right after a crash near Spaghetti Junction?

If you can, get to a safe spot, call 911 and accept medical help. Ask the officer for the report number. Take photos of the vehicles, the lanes and, if a truck was involved, the company name and DOT number on the cab. Get names and phone numbers from witnesses. Then hold off on giving a recorded statement to the other driver's insurer until you've talked with a lawyer.

Can Gary help me if I don't speak English well?

Yes. Gary Huggins speaks Spanish and can explain your claim, the police report and every insurance letter in Spanish, so nothing gets lost in translation. You can meet him at our Perimeter Center office, at your home or by video, and the website has Spanish-language pages with the same Georgia information.

How long does a Doraville personal injury case take?

It depends on your injuries, the insurance involved and whether the other side disputes fault. Many claims can't be valued until you finish treatment or your doctor can say what future care you'll need. Some resolve through negotiation; others require a lawsuit in the State Court of DeKalb County or another court. Gary can't promise a timeline, but he'll keep you updated at every step.

What if the driver who hit me in Doraville drove off?

Call 911 or Doraville Police and report it right away. Leaving the scene breaks Georgia law, which requires every driver in a crash to stop, share their information and give aid to anyone injured (O.C.G.A. § 40-6-270). If the driver is never found, your own uninsured motorist coverage may pay, but hit-and-run UM claims come with reporting and proof requirements. Witness names, photos and nearby business cameras can make the difference.

Do I have a case if I was hit at a MARTA bus stop?

Possibly. The driver who hit you may be responsible, and if a MARTA bus was involved, the claim may also involve a public transit system with special notice rules and shorter deadlines. If you were a passenger, Georgia requires carriers of passengers to use extraordinary diligence to protect them (O.C.G.A. § 46-9-132). Call right away so no notice deadline slips by.

Is a Doraville case handled in DeKalb or Gwinnett County?

Doraville is in DeKalb County, close to the Gwinnett line. A lawsuit is often filed in the State Court of DeKalb County in Decatur, but venue depends on who is being sued: if the at-fault driver lives in Gwinnett, the case may be filed in Lawrenceville instead. A crash a few miles up Buford Highway or Peachtree Industrial may also be a Gwinnett crash.
