Roswell's daily traffic runs on GA-400, Holcomb Bridge Road and Alpharetta Highway, and a crash on any of them can mean weeks or months of treatment. That's where Gary Huggins of Huggins Accident Injury Lawyer comes in. As a Roswell personal injury lawyer, he deals with the insurance companies so you can focus on healing, and he can meet you at home or in the hospital.

GA-400 and Holcomb Bridge Road: Roswell's pressure points

GA-400 carries commuters between Roswell and Atlanta every day. Traffic can drop from highway speed to a standstill within a few hundred feet, which is how many rear-end crashes start.

Southbound, drivers also funnel into the rebuilt I-285 / GA-400 interchange from GDOT's Transform 285/400 project, with its collector-distributor lanes and flyovers. Last-second lane changes on those ramps lead to sideswipe crashes.

Holcomb Bridge Road is a main east–west route through Roswell, with an interchange at GA-400 and long stretches of shopping-center entrances. Left turns across traffic and drivers squeezing toward the GA-400 ramps set up side-impact and rear-end crashes. A rear-end crash can injure your neck or back even when both cars look fine.

Alpharetta Highway, Canton Street and the side roads

  • Alpharetta Highway (SR-9) runs north–south through Roswell, with retail driveways and frequent traffic signals.
  • Canton Street and the historic district draw diners and shoppers on foot, along with drivers hunting for parking.
  • Old Alabama Road, Mansell Road, Riverside Road and SR-92 (Crossville Road) carry neighborhood and commuter traffic.

People walking to dinner on Canton Street or visiting Roswell Mill and Vickery Creek have the law on their side in a crosswalk: a driver must stop and remain stopped when a pedestrian there is on the driver's side of the road or approaching it closely (O.C.G.A. § 40-6-91).

Riders need the same care. Drivers must give a cyclist at least three feet when passing (O.C.G.A. § 40-6-56). Georgia requires helmets for every motorcyclist (O.C.G.A. § 40-6-315) and bans lane splitting (O.C.G.A. § 40-6-312); an insurer may raise either one, but neither automatically ends a claim against a driver who caused the crash.

Wellstar North Fulton Hospital and the days after the ER

Roswell has a trauma center of its own. The Georgia Department of Public Health lists Wellstar North Fulton Hospital as a Level II trauma center, so serious crash injuries can often be treated close to home. Patients who need the highest level of care may be moved to Grady Memorial, a Level I trauma center in downtown Atlanta.

After the ER, keep every follow-up appointment and tell each doctor about every symptom, even ones that seem minor. Insurers read medical records line by line, looking for gaps and missed visits.

Getting your report from Roswell Police

Roswell Police investigate crashes inside the city. On GA-400, Roswell officers or the Georgia State Patrol may respond.

Start with BuyCrash.com, which carries reports for most metro agencies within a few days (there's a small fee). No luck? The Roswell Police records unit can provide a copy.

Check the report for mistakes, like the wrong lane, a missing witness or a reversed diagram, and tell Gary. Other evidence can correct the picture.

Want him to request the report and look it over? Call (240) 421-5511.

Georgia law for Roswell drivers

Two years, with shorter exceptions

The basic deadline to sue over a Roswell crash is two years (O.C.G.A. § 9-3-33), counted from the date of death if a loved one was killed. Claims against the City of Roswell need written notice within six months (O.C.G.A. § 36-33-5); claims against Fulton County or a state agency such as GDOT need notice within 12 months.

Fault and the 50% bar

A rear-end crash usually points to the driver in back, but insurers still argue sudden lane changes or brake-checking. A finding that you were 50% or more at fault means no recovery at all; anything less reduces your damages by your share (O.C.G.A. § 51-12-33).

Whose insurance pays

As an at-fault state, Georgia puts the bill on the at-fault driver's insurer. The legal minimum covers $25,000 per injured person and $50,000 per crash, plus $25,000 in property damage. When that isn't enough, your own uninsured/underinsured motorist coverage can help, and our article on add-on vs. reduced-by UM coverage explains the two types.

Seat belts are now evidence

SB 68, the 2025 tort-reform law, lets juries hear that an injured person wasn't wearing a seat belt, in pending cases as well as new ones (O.C.G.A. § 40-8-76.1(d)). Buckle up every trip, and tell Gary exactly what happened.

Why your Roswell case may be filed in downtown Atlanta

Roswell is in Fulton County, and Fulton's State Court and Superior Court sit in downtown Atlanta, at the Justice Center Tower (185 Central Ave SW) and the Lewis R. Slaton Courthouse (136 Pryor St SW). A lawsuit against a driver who lives in Fulton usually goes there.

If the at-fault driver lives in Cobb, Forsyth or Gwinnett, the lawsuit may have to be filed where that driver lives. Many claims resolve without ever reaching a courtroom, and Gary handles the filings if yours does.

Questions people ask about roswell personal injury

I was rear-ended on Holcomb Bridge Road. Is the other driver automatically at fault?

Not automatically, though the driver in back usually has a duty to keep a safe distance and pay attention. Insurers sometimes argue the front driver stopped short or cut in. Georgia's 50% rule still lets you recover if you're found less than half at fault, minus your share. Photos of both cars, witness names and any dash-cam or business video help settle the question.

Is Wellstar North Fulton Hospital a trauma center?

Yes. Wellstar North Fulton Hospital in Roswell appears on the Georgia Department of Public Health's list as a Level II trauma center, which means it is set up to treat many serious crash injuries. Patients who need the highest level of care may be transferred to Grady Memorial Hospital in downtown Atlanta, which holds Level I status. Ask each facility that treats you for copies of your records.

Can not wearing a seat belt hurt my Roswell injury claim?

It can now. Georgia's 2025 tort-reform law, SB 68, allows evidence that you weren't buckled to be admitted on negligence, causation and apportionment of fault, including in cases already pending (O.C.G.A. § 40-8-76.1(d)). A judge can still keep it out if it would be unfairly prejudicial, and it can't be used to cancel your insurance or raise your premium. Read more about seat belt evidence under SB 68.

What's the difference between add-on and reduced-by UM coverage?

Both protect you when the at-fault driver has too little insurance. Add-on (excess) UM pays on top of that driver's limits, while reduced-by UM subtracts what that driver's insurer pays. With hypothetical numbers: if the other driver has $25,000 and you carry $100,000 in add-on UM, you could have as much as $125,000 available; with reduced-by, the total is $100,000. Since 2009, Georgia policies are add-on unless you rejected it in writing.

Will the other driver's insurance pay for my car and a rental after a Roswell crash?

It should, if their driver caused the crash. You can claim the cost to repair or replace your car and a reasonable rental or loss of use. Georgia gives you four years for property damage claims (O.C.G.A. § 9-3-31), but there's no reason to wait. If you have collision coverage, your own insurer may fix your car first and then seek repayment from the other insurer.
